COVID-19 Prevention Regulations for Public Accommodations

The Nevada State Legislature passed Senate Bill 386 (SB 386) in an effort to prevent COVID-19 transmission in Public Accommodations. From this, the Nevada Department of Health and Human Services developed Regulations regarding COVID-19 prevention standards at Public Accommodation Facilities (NAC 447 E), which the Southern Nevada Health District Board of Health adopted. Enforcement of these Regulations began on October 5, 2020 and will continue until the Nevada State legislature removes the statutory requirements.

The Regulations require all Public Accommodation facilities establish protocols to prevent and respond to COVID-19 in their facilities, and can be broken down into 3 broad categories:

  • Having and maintaining a COVID -19 Prevention and Response Plan
  • Standards for Cleaning to Reduce Transmission of COVID-19
  • Standards to protect employee health against COVID-19

In order to help operators meet these new regulatory mandates, SNHD has developed and attached guidance tools for operators to use, which include:

An example COVID-19 Prevention and Response Plan
The law requires all facilities establish, implement and maintain a written response plan to monitor and respond to COVID-19 infections among employees and guests. This example SOP outlines many of the measures facilities must take to meet the requirements and can be tailored as needed to meet a facility’s specific situation. Each facility needs to have a designated person responsible for overseeing their prevention plan.

A one-page summary of the prevention standards
The law requires facilities post a one-page summary of SB 4’s COVID-19 prevention standards. This summary also serves as a checklist of items SNHD will verify are in place when doing compliance inspections.

A list of key contact numbers at SNHD
The law requires facilities post a list of key contacts at the local public health agency.
Both the one-page summary of standards and the public health contact lists are required to be posted at each employee entrance and on each bulletin board where the facility regularly posts official communications with employees.

SB 4 requires SNHD to conduct compliance inspections and complaint investigations to verify that COVID-19 prevention standards are maintained. The inspection frequency is as follows:

  • Resort hotels must be inspected every 2 months
  • Non-resort hotels with more than 200 rooms must be inspected every 3 months
  • Non-resort hotels with fewer than 200 rooms must be inspected annually

Our goal is to provide you with the tools to understand and successfully implement SB 4 requirements. Please review the attachments, including SB 4 and NAC 447 E which detail the prevention standards, inspection requirements and administrative fines for non-compliance.
