Solid Waste Management Authority Hearing Officer Meeting

The Solid Waste Hearing Officer, under authority granted in Nevada Revised Statute (NRS) 444.629, conducts monthly hearings to settle cases involving illegal dumping and other solid waste matters. At the July 12, 2012 hearing the following cases were adjudicated:

I. Matters Requiring Hearing Officer Action

A. Notices of Violation with Contested Facts

1. Brandon J. Park and Camrin Park – NOV #SW12-046/26- For 1) failure to comply with the Order issued by the Solid Waste Management Authority on December 9, 2011; and 2) for violation of Southern Nevada Health District Regulations Governing Individual Sewage Disposal Systems and Liquid Waste Management Section 10.6.2. (for possible action)

   Hearing officer found Brandon J. Park and Camrin Park in violation and imposed a penalty of $500 for each of 1) and 2). A Cease and Desist order is issued to stop operating a solid waste disposal site without a permit from the solid waste management authority at this location or any other in Clark County, Nev. Installation of septic tank is ordered.

2. Henry Chow – NOV #SW12-282/24- For 1) operating a disposal site in Clark County, Nevada, without a permit issued by the solid waste management authority on or about February 27, 2012; and 2) placing, depositing or dumping or causing to be placed, deposited or dumped solid waste upon the property located at 8560 South Eastern Avenue, Henderson, Clark County, Nevada on or about February 27, 2012. (for possible action)

   Hearing officer found Henry Chow in violation and imposed a penalty of $900 for each of 1) and 2). A Cease and Desist order is issued to stop operating a solid waste disposal site without a permit from the solid waste management authority at this location or any other in Clark County, Nev.

3. Karina Castro-Ruiz – NOV #SW12-408/G9- For 1) operating a disposal site in Clark County, Nevada, without a permit issued by the solid waste management authority on or about March 13, 2012; and 2) placing, depositing or dumping or causing to be placed, deposited or dumped solid waste upon the public right-of-way located west of 35 North Mojave Road and south of 41 North Mojave Road and 61 North Mojave Road, Las Vegas, Clark County, Nevada on or about March 13, 2012. (for possible action)

   Item withdrawn by the Southern Nevada Health District.

4. Michelle R. Wythe – NOV #SW12-014/A0- For 1) operating a disposal site in Clark County, Nevada, without a permit issued by the solid waste management authority on or about January 4, 2012; and 2) placing, depositing or dumping or causing to be placed, deposited or dumped solid waste upon the vacant parcel located south of West Levi Avenue and west of Charismatic Court, Clark County, Nevada on or about January 4, 2012. (for possible action)
   
   Item continued to September 13, 2012 agenda.
5. Mountain Hill, LLC – NOV #SW11-998/A0/A0- For failure to comply with the Order issued by the Solid Waste Management Authority Hearing Officer on January 12, 2012. (for possible action)

   Hearing officer found Mountain Hill, LLC in violation and imposed a penalty of $2,800. Corrective action of removal and proper disposal of waste is ordered. A Cease and Desist order is issued to stop operating a solid waste disposal site without a permit from the solid waste management authority at this location or any other in Clark County, Nev.

6. RG-Rivera Residential #1, LLC – NOV #SW11-1223/08- For 1) operating a disposal site in Clark County, Nevada, without a permit issued by the solid waste management authority on or about September 23, 2011; and 2) failure to comply with the Order issued by the Solid Waste Management Authority on September 30, 2011. (for possible action)

   Hearing officer found RG-Rivera Residential #1, LLC in violation of 2) and imposed a penalty of $500. A Cease and Desist order is issued to stop operating a solid waste disposal site without a permit from the solid waste management authority at this location or any other in Clark County, Nev.

7. Frank Tam Che-Wang and Janet Tam Chi-Yan – NOV #SW12-145/E0- For 1) operating a disposal site in Clark County, Nevada, without a permit issued by the solid waste management authority on or about January 20, 2012; and 2) failure to comply with the Order issued by the Solid Waste Management Authority on January 25, 2012. (for possible action)

   Hearing officer found Frank Tam Che-Wang and Janet Tam Chi-Yan in violation of 2) and imposed a penalty of $500. A Cease and Desist order is issued to stop operating a solid waste disposal site without a permit from the solid waste management authority at this location or any other in Clark County, Nev. Failure to comply will result in the original penalty of $1,800 as initially sought in the Notice of Violation.

8. Carl D. Sparks – NOV #SW11-1665/C6- For 1) operating a disposal site in Clark County, Nevada, without a permit issued by the solid waste management authority on or about December 28, 2011; and 2) failure to comply with the Order issued by the Solid Waste Management Authority on February 1, 2012. (for possible action)

   Hearing officer found Carl D. Sparks in violation of 2) and imposed a penalty of $500. Corrective action of removal and proper disposal of waste is ordered. A Cease and Desist order is issued to stop operating a solid waste disposal site without a permit from the solid waste management authority at this location or any other in Clark County, Nev. Failure to comply will result in the original penalty of $1,800 as initially sought in the Notice of Violation.

9. Imitations, LLC – NOV #SW12-122/C6- For 1) operating a disposal site in Clark County, Nevada, without a permit issued by the solid waste management authority on or about January 12, 2012; and 2) failure to comply with the Order issued by the Solid Waste Management Authority on January 19, 2012. (for possible action)

   Hearing office found Imitations, LLC in violation of 2) and imposed a penalty of $500. A Cease and Desist order is issued to stop operating a solid waste disposal site without a permit from the solid waste management authority at this location or any other in Clark County, Nev. Failure to comply will result in the original penalty of $1,800 as initially sought in the Notice of Violation.

10. Rainbow Structures LLC and Halston Mikail – NOV #SW12-262/C6- For 1) operating a disposal site in Clark County, Nevada, without a permit issued by the solid waste management authority on or about March 1, 2012; and 2) failure to comply with the Order issued by the Solid Waste Management Authority on March 1, 2012. (for possible action)
    
    Hearing officer found Rainbow Structures LLC and Halston Mikail in violation and imposed a penalty of $900 for each of 1) and 2). Corrective action of removal and proper disposal of waste is ordered. A Cease and Desist order is issued to stop operating a solid waste disposal site without a permit from the solid waste management authority at this location or any other in Clark County, Nev.
11. Federal National Mortgage Association – NOV #SW10-2155/G9/23/C6- For failure to comply with the Order issued by the Solid Waste Management Authority Hearing Officer on March 8, 2012. (for possible action)
    
    Hearing officer found Federal National Mortgage Association in violation and imposed a penalty of $7,400. Corrective action of removal and proper disposal of waste is ordered. A Cease and Desist order is issued to stop operating a solid waste disposal site without a permit from the solid waste management authority at this location or any other in Clark County, Nev.
12. Nuts and Bolts Real Estate Holdings, LLC, Pine Nuts, L.L.C. dba Outside Inn and William R. Phillips – NOV #SW12-226/C6- For 1) operating a disposal site in Clark County, Nevada, without a permit issued by the solid waste management authority on or about February 17, 2012; and 2) failure to comply with the Order issued by the Solid Waste Management Authority on February 21, 2012. (for possible action)

    Hearing officer found Nuts and Bolts Real Estate Holdings, LLC, Pine Nuts, LLC dba Outside Inn and William R. Phillips in violation and imposed a penalty of $900 for each of 1) and 2). Corrective action of removal and proper disposal of waste is ordered. A Cease and Desist order is issued to stop operating a solid waste disposal site without a permit from the solid waste management authority at this location or any other in Clark County, Nev.

13. Khusrow Roohani Family Trust – NOV #SW11-819/C6- For 1) operating a disposal site in Clark County, Nevada, without a permit issued by the solid waste management authority on or about June 15, 2011; and 2) failure to comply with the Order issued by the Solid Waste Management Authority on June 16, 2011. (for possible action)

    Hearing officer found Khusrow Roohani Family Trust in violation of 2) and imposed a penalty of $500. A Cease and Desist order is issued to stop operating a solid waste disposal site without a permit from the solid waste management authority at this location or any other in Clark County, Nev.

14. Moonshell, LLC ETAL – NOV #SW11-977/C6- For 1) operating a disposal site in Clark County, Nevada, without a permit issued by the solid waste management authority on or about July 27, 2011; and 2) failure to comply with the Order issued by the Solid Waste Management Authority on July 28, 2011. (for possible action)

    Hearing officer found Moonshell, LLC ETAL in violation of 2) and imposed a penalty of $500. A Cease and Desist order is issued to stop operating a solid waste disposal site without a permit from the solid waste management authority at this location or any other in Clark County, Nev.

15. Khusrow Roohani Family Trust – NOV #SW11-1101/C6- For 1) operating a disposal site in Clark County, Nevada, without a permit issued by the solid waste management authority on or about August 23, 2011; and 2) failure to comply with the Order issued by the Solid Waste Management Authority on August 24, 2011. (for possible action)

    Hearing officer found Khusrow Roohani Family Trust in violation of 2) and imposed a penalty of $500. Corrective action of removal and proper disposal of waste is ordered. A Cease and Desist order is issued to stop operating a solid waste disposal site without a permit from the solid waste management authority at this location or any other in Clark County, Nev. Failure to comply will result in the original penalty of $1,800 as initially sought in the Notice of Violation.

16. Big Teton, LLC – NOV #SW11-1362/C6- For 1) operating a disposal site in Clark County, Nevada, without a permit issued by the solid waste management authority on or about October 12, 2011; and 2) failure to comply with the Order issued by the Solid Waste Management Authority on October 19, 2011. (for possible action)

    Hearing officer found Big Teton, LLC in violation of 2) and imposed a penalty of $500. A Cease and Desist order is issued to stop operating a solid waste disposal site without a permit from the solid waste management authority at this location or any other in Clark County, Nev.

17. Khusrow Roohani Family Trust – NOV #SW11-1363/C6- For 1) operating a disposal site in Clark County, Nevada, without a permit issued by the solid waste management authority on or about October 12, 2011; and 2) failure to comply with the Order issued by the Solid Waste Management Authority on October 19, 2011. (for possible action)

    Hearing officer found Khusrow Roohani Family Trust in violation of 2) and imposed a penalty of $500. A Cease and Desist order is issued to stop operating a solid waste disposal site without a permit from the solid waste management authority at this location or any other in Clark County, Nev.

18. KP & TP LLC – NOV #SW11-1464/C6- For 1) operating a disposal site in Clark County, Nevada, without a permit issued by the solid waste management authority on or about November 2, 2011; and 2) failure to comply with the Order issued by the Solid Waste Management Authority on December 14, 2011. (for possible action)

    Hearing officer found KP & TP LLC in violation of 2) and imposed a penalty of $500. A Cease and Desist order is issued to stop operating a solid waste disposal site without a permit from the solid waste management authority at this location or any other in Clark County, Nev.

B. Non-Contested Notices of Violation: The Hearing Officer may approve or disapprove the agreed resolution. Upon disapproval of the agreed resolution, the Hearing Officer will set a date for the hearing of any such Notice of Violations.

1. Gerardo A. Mariano and Araceli M. Mariano – NOV #SW12-472/C6- For 1) operating a disposal site in Clark County, Nevada, without a permit issued by the solid waste management authority on or about March 27, 2012; and 2) placing, depositing or dumping or causing to be placed, deposited or dumped solid waste upon the property located east of Hualapai Way and south of Peace Way, Clark County, Nevada on or about March 27, 2012. (for possible action)

   Hearing officer found Gerardo A. Mariano and Araceli M. Mariano in violation of 2) and imposed a penalty of $500. A Cease and Desist order is issued to stop operating a solid waste disposal site without a permit from the solid waste management authority at this location or any other in Clark County, Nev. Failure to comply will result in the original penalty of $1,800 as initially sought in the Notice of Violation.

2. Forrest Bukala Wang – NOV #SW12-488/C6- For 1) operating a disposal site in Clark County, Nevada, without a permit issued by the solid waste management authority on or about March 23, 2012; and 2) placing, depositing or dumping or causing to be placed, deposited or dumped solid waste in a trash receptacle located at 6555 West Gary Avenue, Clark County, Nevada on or about March 23, 2012. (for possible action)

   Hearing officer found Forrest Bukala Wang in violation of 2) and imposed a penalty of $500. A Cease and Desist order is issued to stop operating a solid waste disposal site without a permit from the solid waste management authority at this location or any other in Clark County, Nev. Failure to comply will result in the original penalty of $1,800 as initially sought in the Notice of Violation.

3. Raul Cabrera – NOV #SW12-464/G9- For 1) operating a disposal site in Clark County, Nevada, without a permit issued by the solid waste management authority on or about March 20, 2012; and 2) placing, depositing or dumping or causing to be placed, deposited or dumped solid waste upon the property located at 330 East Charleston Boulevard, Las Vegas, Clark County, Nevada on or about March 20, 2012. (for possible action)

   Hearing officer found Raul Cabrera in violation of 2) and imposed a penalty of $500. A Cease and Desist order is issued to stop operating a solid waste disposal site without a permit from the solid waste management authority at this location or any other in Clark County, Nev. Failure to comply will result in the original penalty of $1,800 as initially sought in the Notice of Violation.

4. Top Dollar Recycling, LLC – NOV #SW12-206/G7- For 1) operating a disposal site in Clark County, Nevada, without a permit issued by the solid waste management authority on or about January 18, 2012 and January 19, 2012. (for possible action)

   Hearing officer found Top Dollar Recycling, LLC in violation and imposed a penalty of $1,500. A Cease and Desist order is issued to stop operating a solid waste disposal site without a permit from the solid waste management authority at this location or any other in Clark County, Nev. Failure to comply will result in the original penalty of $1,800 as initially sought in the Notice of Violation.

5. Pipe Maintenance Service, Inc. – NOV #SW12-198/32- For 1) operating a disposal site in Clark County, Nevada, without a permit issued by the solid waste management authority on or about February 8, 2012; and 2) placing, depositing or dumping or causing to be placed, deposited or dumped solid waste upon the vacant parcel located at 10450 Gilespie Street, Clark County, Nevada on or about February 8, 2012. (for possible action)
   
   Hearing officer found Pipe Maintenance Service, Inc. in violation of 2) and imposed a penalty of $900. Corrective action of removal and proper disposal of waste is ordered. Retention of a Certified Environmental Manager (CEM) is ordered. Failure to comply will result in the original penalty of $1,800 as initially sought in the Notice of Violation.
6. Genesis Holdings LLC – NOV #SW12-048/C6- For 1) operating a disposal site in Clark County, Nevada, without a permit issued by the solid waste management authority on or about January 10, 2012; and 2) failure to comply with the Order issued by the Solid Waste Management Authority on February 21, 2012. (for possible action)

   Hearing officer found Genesis Holdings, LLC in violation of 2) and imposed a penalty of $900. Corrective action of removal and proper disposal of waste is ordered. A Cease and Desist order is issued to stop operating a solid waste disposal site without a permit from the solid waste management authority at this location or any other in Clark County, Nev. Failure to comply will result in the original penalty of $1,800 as initially sought in the Notice of Violation.

7. Roberto Barajas Vazquez – NOV #SW12-503/C6- For 1) operating a disposal site in Clark County, Nevada, without a permit issued by the solid waste management authority on or about March 23, 2012; and 2) placing, depositing or dumping or causing to be placed, deposited or dumped solid waste upon the property located at 8425 Spring Mountain Road, Clark County, Nevada on or about March 23, 2012. (for possible action)

   Hearing officer found Roberto Barajas Vazquez in violation of 2) and imposed a penalty of $500. A Cease and Desist order is issued to stop operating a solid waste disposal site without a permit from the solid waste management authority at this location or any other in Clark County, Nev. Failure to comply will result in the original penalty of $1,800 as initially sought in the Notice of Violation.
